By purchasing any products or services through Testing & Assessment Services Pvt Ltd, you signify that you have read, understand and agree to be bound by the Terms of Sale in effect at the time of purchase ("Terms of Sale"). Your purchases and your use of Tesfunda are also governed by the Terms of Use, which are incorporated herein by reference.

These Terms of Sale are subject to change, without prior notice, at any time, in the Company's sole discretion, and such changes shall apply to any purchases made after such changes are posted to the Site. Termination by you: You may, at any time, choose to terminate your subscription to a service by sending us an email at contact@testfunda.com. Such termination shall not affect any outstanding payment obligations to the Company.

Termination by Testing & Assessment Services Pvt Ltd: If you breach any of the terms of this Agreement, including but not limited to non-payment of fees, providing inaccurate or incomplete registration data, failure to safeguard your account information, or infringement of third-party rights, Testing & Assessment Services Pvt Ltd may, after notice to you, terminate your subscription and/or account.

No refunds will be issued for early termination.

Use of the Service requires compatible hardware, software, and internet access. Your ability to access and use the Service may be affected by these factors. You acknowledge and agree that ensuring compatibility with system requirements is solely your responsibility.

All payments must be made in Indian Rupees (INR).

All purchases made through Testing & Assessment Services Pvt Ltd are final and non-refundable. However, under exceptional circumstances, you may submit a refund request by emailing contact@testfunda.com within 24 hours of purchase, providing a detailed explanation and relevant transaction details.

Refund requests will be reviewed on a case-by-case basis at the sole discretion of Testing & Assessment Services Pvt Ltd. If approved, the refund will be processed using the original payment method, subject to any applicable processing fees. Refund requests submitted beyond the 24-hour window will not be considered.

By completing a purchase, you acknowledge and agree to this Refund Policy.

With respect to services purchased through the Site, you acknowledge and agree that upon making such services available to you (or to their intended authorized recipients), Testing & Assessment Services Pvt Ltd will have fully satisfied its obligation to deliver or otherwise provide such services, regardless of any failure or inability to use such services.

Testing & Assessment Services Pvt Ltd endeavours to ensure that all product and service descriptions, pricing, images, and other related information provided on the Site are accurate, complete, and current. However, the Company does not warrant or represent that such information will be free from errors, omissions, or inaccuracies. Any violation of this clause may result in immediate suspension or termination of the user account without refund.

All products and services are provided on an "as-is" basis, and the Company disclaims all representations and warranties, express or implied, including but not limited to warranties of title, merchantability, fitness for a particular purpose, or non-infringement. The Company makes no guarantees regarding specific results from the use of its products or services and does not warrant that they will be accurate, complete, reliable, current, or error-free. To the fullest extent permitted by law, Testing & Assessment Services Pvt Ltd, its officers, employees, affiliates, agents, licensors, and suppliers shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, revenue, data, or business opportunities arising from the use of or inability to use the products or services, even if advised of the possibility of such damages. The Company’s total liability for any claim arising under these Terms shall not exceed the amount paid for the specific product or service in question.

These Terms of Sale, together with the Terms of Use, constitute the complete agreement between you and Testing & Assessment Services Pvt Ltd regarding purchases made on its site, superseding all prior agreements related to such transactions. The Company’s failure to exercise or enforce any right or provision under these Terms shall not be construed as a waiver of that right or provision. If any provision of these Terms is deemed invalid, unlawful, void, or otherwise unenforceable, it shall be severed without affecting the validity and enforceability of the remaining provisions. In the event of any conflict between these Terms of Sale and the Terms of Use, these Terms of Sale shall prevail.

These Terms of Sale shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

We shall not be held liable for any delay or failure in fulfilling our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters (acts of God, earthquakes, floods, pandemics), war or threatened war, terrorism or its threats, industrial actions (strikes, lockouts, labor disputes), government-imposed restrictions, fires, explosions, disruptions in communication, transportation, or energy networks, and any other unforeseeable events preventing performance despite reasonable efforts. In such cases, we will make reasonable efforts to notify affected parties and resume performance as soon as feasible but shall not be responsible for any resulting losses or delays.

Failure to enforce any provision of these Terms, or to act upon a breach, shall not be deemed a waiver of our rights. We reserve the right to exercise or enforce our rights and remedies at any time in response to any subsequent breach of these conditions.
